ORDINANCE No. 178697
*Amend Intergovernmental Agreement with the Oregon Department of Transportation to provide additional funds for the reconstruction of Front Ave. from Harrison Street to Everett Street (Ordinance; amend Contract No.50661)
The City of Portland ordains:
Section 1. The Council finds:
1. Front Ave (Naito Parkway) has been a significant roadway corridor serving downtown Portland for the past 156 years. It offers a continuous route to and from I-5 from the Central City Business district. It is a primary E/W connection for pedestrians and bicyclists destined for Waterfront Park. It carries an Average Daily Traffic count of 30,000 vehicles.
2. Front Ave has deteriorated to the point that total reconstruction is required to achieve meaningful restoration. Pedestrian crossings are in need of repair and upgrading to ADA standards. The street lacks bicycle facilities, proper drainage and water treatment facilities.
3. This road improvement project was approved September 13, 1995, as part of the 1996-1998 Statewide Transportation Improvement Program (STIP).
4. The original agreement was for $2,368,000 (No. 50661) between the City of Portland (City) and the Oregon Department of Transportation (ODOT) dated April 19,1996 and approved by Council, Ordinance No. 169926.
5. The agreement was amended on December 31,1997 (Supplemental No.1) to provide Surface Transportation Program (STP) 33C funds of $1,811,000 and STP 33D funds of $558,000.
6. The current Project cost to reconstruct Front Ave from SW Main to NW Couch is estimated at $9,102,000.
7. This Second Amendment (Supplemental No.2) will increase funding to $6,174,000 in federal STP funds and $558,000 in State STP funds. The City of Portland has agreed to pay the required local match equal to 10.275% of the Surface Transportation Program funds.
8. Funds for the match requirement are budgeted in FY 04/05 for the Bureau of Transportation Engineering and Development.
9. This is a City managed engineering and construction project with oversight by ODOT.
10. Construction is scheduled for the fall of 2005.
NOW, THEREFORE, the Council directs:
a. The Director of the Portland Office of Transportation and the Auditor are hereby authorized to enter into an amended Agreement with the Oregon Department of Transportation, similar in form to the agreement attached to the original of this ordinance, and by this reference made a part thereof.
Section 2. The Council declares that an emergency exists because delay in executing this agreement will delay construction; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
