ORDINANCE No. 178624

 

 

*Amend contract with Shiels Obletz Johnsen, Inc. for project management services in connection with the Preliminary Engineering Phase of the Portland Transit Mall Project. (Ordinance; amend Contract No. 34662)

 

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  Pursuant to Code Section 5.68.035, the City entered into an agreement, Contract No. 34662 (Ordinance No. 177263) with Shiels Obletz Johnsen, Inc. for project management services in connection with the Portland Transit Mall Revitalization Project on February 19, 2003, .

 

2.  Shiels Obletz Johnsen prepared and completed the Public Discussion-Draft Conceptual Design Report for the Portland Transit Mall Project, and completed the first of two major products identified in the original Statement of Work on June 25, 2003.

 

3.  The City Council passed Ordinance No. 177660 approving Amendment No. 1 to Shiels Obletz Johnsen contract to include additional public outreach requested and funded by TriMet on July 2, 2003.

 

4.  City Council passed Ordinance No. 177810 approving Amendment No. 2 to the Shiels Obletz Johnsen contract to complete the second major product, the Final Conceptual Design Report, including modifications to the Statement of Work and Fees on August 27, 2003.

 

5.  City Council passed Ordinance No. 178246 approving Amendment No. 3 to the Shiels Obletz Johnsen contract to the complete the preparation, public review, and adoption of the Portland Mall Revitalization Conceptual Design Report, including modifications to the Statement of Work and Fees on March 17, 2004.

 

6.  City Council passed Resolution No. 36216, adopting the Conceptual Design Report-Final Supplement for the Portland Mall Revitalization Project, and directed PDOT to prepare a South Corridor Financial Plan and status report on Preliminary Engineering Status design issues, Mall Management Strategies, and Revitalization Strategies on May 19, 2004.

 

7.  PDOT will require the project management services of Shiels Obletz Johnsen, Inc. to complete the Financial Plan and the Preliminary Engineering Status Report.

 

8.  Amendment No. 4 amends the Shiels Obletz Johnsen, Inc. contract to complete the issues identified in Resolution No. 36216, and includes modifications to the Statement of Work and Fees, Exhibit A.

 

9.  Amendment No. 4 provides for additional compensation not to exceed $299,480.

 

10.  The contractor, the Shiels Obletz Johnsen, Inc., may re-allocate fees and hours within the Maximum Compensation as necessary to accomplish the Scope of Work.

 

11.  PDOT has the resources in its existing budget for this amendment.

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner of Public Utilities and the Auditor are authorized to sign an amendment to the contract with the Shiels Obletz Johnsen, Inc., similar in form to the agreement attached to the original of this ordinance and by this reference made a part hereof.

 

Section 2. The Council declares that an emergency exists because delay in completing this amended agreement could result in a delay in the completion of the project; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
