Declare intent to initiate local improvement district formation proceedings to construct street improvements in the SE Ellis Street Local Improvement District (Resolution; C-10010)

 

WHEREAS, City Council formed the Lents III / SE 104th & Ramona Local Improvement District on August 6, 2003, and the Lents III Extension Local Improvement District on November 19, 2003, and the property owners in the proposed SE Ellis Street Local Improvement District wish to combine construction of all three of these local improvement districts for economy of scale; and

 

WHEREAS,  valid petitions from owners of properties within the proposed SE Ellis Street Local Improvement District were filed with the Local Improvement District Administrator as contained in Exhibit A (attached to the original only), and the Bureau of Transportation Engineering & Development is the Responsible Bureau for the proposed improvement and recommends initiation of a local improvement district; and

 

WHEREAS,  the petitions contain signature of owners or contract purchasers of property representing a majority of the abutting linear footage which will be specially benefited by the proposed improvement as evaluated in Exhibit B; and

 

WHEREAS,  the current eastern terminus of the existing right-of-way of SE Ellis Street is 250 feet east of the east line of SE 104th Avenue, but will extend to 370 feet east of the east line of SE 104th Avenue once two right-of-way dedications of 3,000 square feet each are completed, which are anticipated to occur on May 21, 2004.

 

NOW, THEREFORE, BE IT RESOLVED, that the City Council declares the intent of the City to initiate local improvement district formation proceedings to construct street improvements on SE Ellis Street from 200 feet east of the east line of SE 104th Avenue to 370 feet east of the east line of SE 104th Avenue; and

 

BE IT FURTHER RESOLVED, that the local improvement district shall be known as the SE Ellis Street Local Improvement District and for purposes of the Local Improvement District Formation Hearing as set forth in Section 17.08.070 of City Code, the boundary shall be as shown in the map in Exhibit C; and

 

BE IT FURTHER RESOLVED, that the general character and scope of the improvement is to remove the existing dirt, gravel and/or hard surface; grade streets to their proper subgrade; construct asphaltic concrete streets with an aggregate base; construct stormwater drainage facilities consisting of a combination soakage trench and swale in most locations; construct sidewalks on both sides of the street; and plant street trees in most locations, unless this project scope is modified by City Council at the Local Improvement District Formation Hearing; and

BE IT FURTHER RESOLVED, that the preliminary estimate of the cost of the improvement is $99,300; and

 

BE IT FURTHER RESOLVED, that the assessment methodology of the local improvement district shall be on an abutting linear footage basis, unless this assessment methodology is modified by City Council at the Local Improvement District Formation Hearing; and

 

BE IT FURTHER RESOLVED, that property owners will provide funding estimated at $81,582 plus the costs of any extra work on private property, and the Portland Office of Transportation will absorb overhead costs estimated at $17,717; and

 

BE IT FURTHER RESOLVED, that the project will be bid through the Bureau of Purchases with the construction contract to be combined with the Lents III / SE 104th & Ramona Local Improvement District and the Lents III Extension Local Improvement District, and will be awarded to the lowest responsible bidder through a competitive bid process, and costs will generally be allocated among the three LIDs based on the centerline footage of street constructed; and

 

BE IT FURTHER RESOLVED, that the City Council intends to construct the improvement upon formation of the local improvement district; and

 

BE IT FURTHER RESOLVED, that the City Council directs the Local Improvement District Administrator to initiate local improvement district formation proceedings as set forth in Section 17.08.070 of City Code and to schedule a Local Improvement District Formation Hearing on July 28, 2004 at 9:30 AM or on the earliest practicable date thereafter.
