ORDINANCE No. 178275

* Amend contract with the Portland Metropolitan Softball Association to extend the current agreement to March 31, 2005 (Ordinance; amend Contract No. 50624)

The City of Portland ordains:

Section 1. The Council finds:

1.  Portland Parks and Recreation entered into Contract #50624 with the Portland Metropolitan Softball Association on April 1, 1993 for the exclusive priviledge of operating all concessions at East Delta Park. Said Contract was extended for one five-year period by Ordinance No. 171066 on March 28, 1997. Portland Parks and Recreation has had similar agreements with the Portland Metropolitan Softball Association since approximately 1965. The Association uses concession revenue to improve City softball facilities and has contributed over $300,000 to the development of the Wm. V. Owens Softball Complex at East Delta Park.

2.  The said Association is a non-profit Oregon Corporation and will pay the City five percent or $1500.00, whichever is greater, of its annual gross revenues from the operation of said concessions.

3.  Portland Parks and Recreation and the Portland Metropolitan Softball Association have formed a partnership where proceeds from concessions are used to improve the City of Portland’s softball facilities.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities and the Auditor are hereby authorized to extend the termination date of Contract #50624 with the Portland Metropolitan Softball Association to March 31, 2005.

Section 2. The Council declares that an emergency exists because of the softball complex opening operation in April and to maintain continuity of service; therefore, this Ordinance shall be in force and effect from and after its passage by Council..
