RESOLUTION No. 36157

Declare the intent to initiate local improvement district formation proceedings to construct street improvements in the Lents III/SE 104th and Ramona Local Improvement District. (Resolution; C-9999)

WHEREAS, valid petitions from owners of properties within the proposed Lents III/SE 104th & Ramona Local Improvement District were filed with the Local Improvement District Administrator as contained in Exhibit A (attached to the original only), and the Bureau of Transportation Engineering and Development is the Responsible Bureau for the proposed improvements and recommends initiation of a local improvement district; and

WHEREAS, the petitions contain signatures of owners of property representing a majority of the area which will be specially benefited by the proposed improvement as evaluated in Exhibit B; and

WHEREAS, the Local Improvement District Administrator has reviewed such petitions and has determined 71 of them to be valid as evaluated in Exhibit B; and

WHEREAS, the Lents Urban Renewal Advisory Committee and the Lents Project Advisory Committee have been notified of this project on an ongoing basis since prior to October 9, 2001; and

WHEREAS, the East Portland Land Use Committee was notified of this project on June 11, 2003.

NOW THEREFORE, BE IT RESOLVED, that the City Council declares the intent of the City to initiate local improvement district formation proceedings to construct street improvements on SE Ellis Street from 104^th Avenue to 50 feet east of the east line of 104^th Avenue (Exhibit G); on SE Reedway Street from 102^nd Avenue to 103^rd Avenue (Exhibit E); on SE Reedway Street from 104^th Avenue to 320 feet east of the east line of 104^th Avenue (Exhibit E); on SE Ramona Street from 102^nd Avenue to 250 feet east of the east line of 104^th Avenue (Exhibit F); on SE Knight Street from 102^nd Avenue to 335 feet east of the east line of 104^th Avenue (Exhibit E); on SE Yukon Street from 102^nd Avenue to 250 feet east of the east line of 104^th Avenue (Exhibit F); and on SE 104^th Avenue from Ellis to 100 feet south of Yukon (Exhibit D); and

BE IT FURTHER RESOLVED, that the local improvement district shall be known as the Lents III/SE 104th & Ramona Local Improvement District and for purposes of notification of the LID Formation Hearing as set forth in Section 17.08. 070 of City Code, the boundary shall be as shown in the map in Exhibit C; and

BE IT FURTHER RESOLVED, that if constructed, the general character and scope of the improvement is to remove the existing dirt, gravel and/or hard surface; grade

streets to their proper subgrade; construct asphaltic concrete streets with an aggregate base; construct stormwater drainage facilities consisting of a combination soakage trench and swale in most locations; construct sidewalks on both sides of the street in most locations; and plant street trees in most locations, unless this project scope is modified by City Council at the LID Formation Hearing; and

BE IT FURTHER RESOLVED, that the preliminary estimate of the cost of improvements is $2,437,584; and

BE IT FURTHER RESOLVED, that the assessment methodology of the local improvement shall be on a square footage basis, unless this assessment methodology is modified by City Council at the LID Formation Hearing; and

BE IT FURTHER RESOLVED, that property owners will provide funding in the amount of $410,838 plus the costs of any extra work on private property, and the Portland Development Commission shall fund the remainder through the Lents Town Center Urban Renewal Area; and

BE IT FURTHER RESOLVED, that the project will be bid through the Bureau of Purchases and will be awarded to the lowest responsible bidder through a competitive bid process; and

BE IT FURTHER RESOLVED, that the City Council intends to construct the improvement upon formation of the local improvement district; and

BE IT FURTHER RESOLVED, that the City Council directs the Local Improvement District Administrator to initiate local improvement district formation proceedings as set forth in Section 17.08.070 of City Code and to schedule a Local Improvement District Formation Hearing on July 30, 2003 at 11:00 AM or on the earliest practicable date thereafter.
