RESOLUTION No. 36141

Approve the Settlement Agreement between the City of Portland and Oregon AFSCME Council 75, Local 189, to resolve the unfair labor practice complaint, Case No. UP-31-01.

WHEREAS,  the City Council authorized the filing of an unfair labor practice complaint against AFSCME on August 2, 2001;

WHEREAS,  the Employment Relations Board has issued a Recommended Order finding that AFSCME engaged in an unlawful strike; and

WHEREAS,  the City now believes it is in the best interest of labor relations to settle the dispute before a final adjudication.

NOW, THEREFORE, BE IT RESOLVED that the Settlement Agreement (attachment A) is approved by the City Council; and

BE IT FURTHER RESOLVED that upon approval of the settlement by AFSCME, Commissioner Francesconi is authorized to sign the Settlement Agreement in substantially the same form as Attachment A hereto and the City Attorney’s Office shall withdraw the unfair labor practice complaint with prejudice.
