ORDINANCE NO. 178167

 

*Authorize a contract and provide for payment for the construction of the Bull Run Dam 2 Tower Improvements Project. (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The City of Portland operates Bull Run Dam 2 in the Bull Run Watershed, and its appurtenances, under the requirements of the Federal Energy Regulatory Commission (FERC). The November 2001 Safety Inspection Report, prepared by FERC, determined that the two supply intake towers within the reservoir impounded by Bull Run Dam 2 require improvements to maintain system reliability, and limit risk and damage that could be caused by a Probable Maximum Flood (PMF) event.

 

2.  These towers are the primary intakes to the City of Portland’s drinking water system.

 

3.  The Bureau of Water Works has final plans and specifications for construction of the Bull Run Dam 2 Tower Improvements.

 

4.  The Bureau of Water Works requires the furnishing of materials, labor and equipment to construct this project.

 

5.  The Oregon Department of Fish and Wildlife restricts in-water construction work in the Sandy River, and its tributary sources in the Bull Run Watershed, to protect annual migratory fish runs. The work period for this drainage is from July 15 through August 31.

 

6.  The estimated cost for the Bull Run Dam 2 Tower Improvements is $1,200,000. Funds are available in the Water Fund, FY 2003-04 and FY 2004-05, Bureau of Water Works, center code 18089934, Project No. 3364, account code 567000.

 

NOW, THEREFORE, The Council directs:

a.  That the Commissioner of Public Affairs and Auditor are authorized to execute on behalf of the City a contract with the lowest responsible bidder for the purpose described in Section 1 hereof, in accordance with the plans and specifications on file with the Purchasing Agent.

b.  The Mayor and the Auditor hereby are authorized to draw and deliver checks when demand is presented and approved by the proper authorities.

 

Section 2. The Council declares that an emergency exists because a delay in proceeding with this project will unnecessarily jeopardize compliance with the requirements of the Oregon Department of Fish and Wildlife for in-water work for construction of this project. Therefore, this Ordinance shall be in force and effect from and after its passage by Council.
