ORDINANCE No. 178149

 

 

*Amend agreement with Oregon Department of Transportation to provide for the Pacific Highway I-5 Interstate Bridge to NE Oregon St, I-5 Preservation, Project (Ordinance; amend Contract No. 51417)

 

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The Oregon Department of Transportation (ODOT) has completed the rehabilitation of the pavement, raising overpasses to increase vertical clearance for traffic on the freeway, and installing sound walls along Interstate 5 in North Portland as envisioned in Agreement #51417 as passed by Ordinance 175007.

 

2.  Construction of some of the sound walls along the project created the need to revised the maintenance responsibilities between the City of Portland (City) and ODOT.

 

3.  ODOT has prepared an amendment to the original Agreement for City approval and execution.

 

 

NOW, THEREFORE, the Council Directs:

 

a.  The Mayor and the Auditor are hereby authorized to enter into an amended agreement with the Oregon Department of Transportation, similar in form to the agreement attached to the original of this ordinance, and by this reference made a part hereof.

 

Section 2. The Council declares that an emergency exists because delay in executing this

agreement would delay maintenance of the improvements completed by this project; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
