ORDINANCE No. 178145

*Pay Claim of Mr. Khalil Zonoozy. (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  Mr Khalil Zonoozy has filed a Bodily Injury Claim against the City for damages suffered in an accident involving a City Driver on April 11, 2002.

2.  The claim has been investigated by the Risk Management Division. Our investigation indicates there is risk the City may be found liable. Therefore, in order to avoid the risk of a large jury award, we feel it is prudent to compromise the Bodily Injury Claim at this time.

3.  The Risk Management Division recommends the Bodily Injury Claim be compromised for $6,872.00, subject to the claimant providing the City with a release in a form to be approved by the City Attorney. Risk Management has previously advanced $2,600.00 to the claimant and $862.00 to Nationwide Insurance in partial payment of Mr Khalil’s Bodily Injury Claim.

NOW, THEREFORE, the Council directs:

a.  The Mayor and the Auditor are hereby authorized to draw and deliver a check in the amount of $3,410.00 made payable to Mr. Khalil Zonoozy. Total claim settlement is $6,872.00.

b.  The Risk Management Division will execute a payment authorization in the amount set forth in sub-paragraph (a) above.

Section 2. The Council declares that an emergency exists in order to avoid undue and costly delay in settling this Bodily Injury Claim; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
