ORDINANCE No. 178141
*Authorize execution of Release and Assignment for claim against Dick’s Towing, Inc. dba R & R Towing (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. Dick’s Towing, Inc. dba R & R Towing (R & R) was a contractor under the City’s Contract for Vehicle Towing and Storage. R & R’s contract was cancelled by the City due to failure of R & R to maintain the required minimum equipment and staff.
2. R & R owed $2,878.31 in City service fees, dispatch service fees, Code Hearing Office fees and contract penalties.
3. The Contract for Vehicle Towing and Storage requires contractors to maintain a performance bond. The City made a claim against R & R’s performance bond, and the bonding company, Old Republic Insurance Company, paid the City’s claim # YMI-211568 in the amount of $2,878.31.
4. Old Republic Insurance Company requested that the City sign a Release and Assignment documenting payment of the claim and the City’s release and assignment of its claim to Old Republic Insurance Company.
NOW, THEREFORE, the Council directs:
a. The Commissioner in Charge of the Bureau of Licenses is authorized to execute the Release and Assignment in the form attached hereto as Exhibit 1.
Section 2. The Council declares that an emergency exists because it is in the interest of the City to complete and resolve this claim as soon as possible; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
