ORDINANCE NO. 178138

* Authorize the Chief Engineer of the Bureau of Water Works to apply for and accept water right permits and certificates for ground water development in the Bull Run. (Ordinance)

The CITY OF PORTLAND ORDAINS:

Section 1. The Council finds:

1.  That the City of Portland Bureau of Water Works is presently developing wells in the Bull Run Watershed in Clackamas County in order to supplement the City’s existing water supplies.

2.  That the Bureau of Water Works may need to secure or otherwise obtain additional ground water rights for future water system purposes in Bull Run.

3.  That all ground waters in the State of Oregon are owned by the State and it is necessary to obtain a permit from the State prior to appropriation and use of water.

4.  That this action has been recommended by the management and Administrator of the Bureau of Water Works, and approved by the Commissioner-in-charge;

NOW, THEREFORE, the Council directs:

a)  That the Chief Engineer is hereby authorized to execute and pursue an application for a permit to appropriate ground waters of the State of Oregon for the development of wells in the Bull Run Watershed in order to supplement the City’s existing water supplies, to authorize payment of associated permit fees, and to accept permits and certificates upon issuance.

Section 2. Declaration of Emergency. The Council declares that an emergency exists because water right priority dates are set by date of application and the longer the City waits to apply for a ground water right, the later will be the priority date of any permit or right ultimately granted. Therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
