ORDINANCE NO. 178122

 

Adopt the 13th Amendment to the Oregon Convention Center Urban Renewal Plan to establish authority to acquire property located at 910 N.E. Martin Luther King Jr. Blvd., including by condemnation if necessary (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The Portland Development Commission (“Commission”) is undertaking projects and activities pursuant to an urban renewal plan adopted in May 1989 by the Portland City Council by Ordinance No. 161925 (the “Plan”); and

 

2.  Section 600 of the Plan states that, in certain circumstances, PDC may acquire real property only after City Council has approved a substantial amendment to the Plan; and

 

3.  The 18,000 s.f. parcel at 910 N.E. Martin Luther King Jr. Blvd (the “Property”) can support development of a Headquarters Hotel to serve the Oregon Convention Center (“OCC”) or other high-density commercial or mixed-use project compatible with the OCC; and

 

4.  Objective 1.1 of the Plan states: “Recruit at least one Headquarters Hotel in the immediate vicinity of the OCC to capitalize on the Oregon Convention Center’s capacity”; and

 

5.  Objective 3.1 of the Plan states: “Encourage lodging, entertainment, restaurant and retail development in the corridor between the Oregon Convention Center and Lloyd Center”; and

 

6.  Goal 5 of the Plan states: “Upgrade the setting and environment of the area to reflect the best of Portland to visitors: encouraging extended convention stays, return visits and business recruitment to Oregon”; and

 

7.  Development of a Headquarters Hotel proximate to the OCC is essential to carrying out the goals and objectives of the Plan; and

 

8.  The Property is a significant parcel that, due to its’ adjacency to other PDC-owned parcels, is uniquely positioned to support development of a Headquarters Hotel or other high-density commercial or mixed-use project compatible with the OCC; and

 

9.  It is necessary for the PDC to acquire the Property in order to accomplish the public purpose of developing a Headquarters Hotel or other Plan objectives; and

 

10.  The PDC Board of Commissioners approved the 13th Amendment to the Plan by Resolution No. 6049 on September 10, 2003; and

 

11.  At its regularly scheduled meeting on December 9, 2003, the City of Portland Planning Commission recommended that City Council approve the 13th Amendment; and

 

12.  The 13th Amendment amends the Plan to establish authority for the Portland Development Commission to acquire the Property including through condemnation if necessary; and

 

13.   The City Council now desires to approve the 13th Amendment to the Oregon

Convention Center Urban Renewal Plan.

 

 

 

 

NOW THEREFORE, the Council directs:

 

 

a.  The 13th Amendment to the Oregon Convention Center Urban Renewal Plan, attached hereto as Exhibit A, and incorporated herein by this reference, having been duly received and considered by Council, is hereby adopted.

 

 

b.  The City Council of the City of Portland approves the acquisition of the property at 910 N.E. Martin Luther King Jr. Blvd., including by condemnation if necessary, and authorizes the Executive Director of the Portland Development Commission to execute any documents necessary to acquire the property.

 

 

c.  The City Auditor shall forward to the Portland Development Commission certified copies of this Ordinance upon adoption by Council.

 

 

d.  The Portland Development Commission shall file in the Deed Records of Multnomah County, Oregon, a copy of this Ordinance and the 13th Amendment upon adoption by Council.

 

 

e.  The City Auditor, in accordance with ORS 457.115, shall publish notice of the adoption of this Ordinance approving the 13th Amendment, including the provisions of ORS 457.135, in the newspaper having the greatest circulation in the City of Portland within four days following the adoption of this Ordinance.
