ORDINANCE No. 178118

* Authorize Right of Entry Agreement with Union Pacific Railroad Company for construction of the Columbia Boulevard Wastewater Treatment Plant Influent Pump Station Capacity Upgrade Project. (Ordinance)

The City of Portland ordains:

Section 1.  The Council finds:

1.  The Bureau of Environmental Services has a need to increase the pumping capacity of the Columbia Boulevard Wastewater Treatment Plant Influent Pump Station to reduce Combined Sewer Overflows into the Willamette River.

2.  Construction of the Influent Pump Station Capacity Upgrade project requires the execution of a Right of Entry Agreement in substantially the same form as attached to provide construction access to the project site.

3.  The estimated cost of the Agreement is $20,000. Funds are available in the Sewer System Operating Fund, FY 2003-04 Budget, Bureau of Environmental Services, Center Code 145-22-110, Project Number 6904, Account No. 563000.

NOW, THEREFORE, the council directs:

 a.  The Chief Engineer of the Bureau of Environmental Services is authorized to execute an Agreement with Union Pacific Railroad Company, in substantially the form of the attached exhibits, for the purpose described in Section 1, in the amount of up to $20,000.

 b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

Section 2.  The Council declares that an emergency exists because timely execution of the Agreement is required to avoid delays in project construction. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
