* Amend Contract with Ball Janik, LLP to provide legal and consulting services for Spectator Facilities Development. (Ordinance; Amend Contract No. 34506)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The City entered into Contract No. 34506 in the amount of $58,500 on October 14, 2002 for Ball Janik, LLP to provide legal and consulting services for Spectator Facilities Development and Operations. The City Attorney’s Office authorized selection of the Contractor under their Code authority to select legal firms for City work.

 

2.  Amendment No. 1, dated March 14, 2003 increased the contract amount by $80,000 and extended Ball Janik’s contract three (3) months, to December 31, 2003.

 

3.  The City requires ongoing professional legal advice and counsel related to the City’s spectator facilities, including PGE Park and the Rose Quarter and their respective development and operating agreements as well as new business opportunities and operational issues.

 

4.  The fee for the continuation of services listed in paragraph 2 above is not to exceed $80,000.

 

5.  The City of Portland and Ball Janik, LLP wish to renew Contract No. 34506 for an additional twelve (12) month period or until December 31, 2004.

 

6.  Contract Amendment No. 2 is attached, signed by the Contractor and approved as to form by the City Attorney (Attachment No. 1).

 

7.  The Bureau of General Services recommends that Agreement No. 34506 with Ball Janik, LLP be amended by $80,000 to provide a continuation of legal and consulting services for Spectator Facilities Development for a total contract amount of $218,500, and extend the contract termination date to December 31, 2004.

 

NOW, THEREFORE, the Council directs:

 

a.  The Mayor and Auditor are authorized to execute Amendment No. 2 attached hereto as Attachment No. 1, with Ball Janik, LLP in the amount of $80,000 for a total contract amount of $218,500.

 

b.  The Mayor and Auditor are authorized to amend Contract No. 34506 with Ball Janik, LLP to extend the expiration date to December 31, 2004.

 

c.  The Mayor and the Auditor are authorized to draw and deliver checks chargeable to the fiscal year 2003-04 Spectator Facilities budget when demand is presented and approved by the proper authorities.

 

Section 2.  The Council declares that an emergency exists because a delay will unnecessarily deprive the City of benefits of completion of the work at an early date; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
