ORDINANCE No. 177681

 

*Authorize a grant to Reach Community Development, Inc. for installation of rainwater harvesting system for toilet flushing and other green building features at Station Place located at NW Ninth Avenue and Lovejoy Street in the amount of $70,000 (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The City Council supports the Office of Sustainable Development’s coordinated and efficient delivery of innovative and cost effective green building technical and outreach services that promote energy and water conservation; on-site energy production; efficient transportation alternatives; the use of healthy building materials; reduced stormwater runoff and erosion; construction site deconstruction, reuse, recycling practices; and minimal site disturbance.

 

2.  The City of Portland recognizes and accepts its responsibility to implement and promote building practices that protect the quality of the air, water, and other natural resources; reduce construction practices that impact native fish, vegetation, wildlife habitat and other ecosystems; and minimizes human impact on local and worldwide ecosystems.

 

3.  The City Council recognizes that green building complements existing policies related to development and natural resource conservation; including the 1990 Energy Policy (Ordinance No. 162975), 2001 Local Action Plan on Global Warming (Resolution No. 35879), Comprehensive Plan, and Metro 2040 Framework Plan.

 

4.  In 1999, the City Council accepted the Green Building Initiative (Resolution No. 35817) to develop an inter-bureau initiative to implement green building standards for all City design, construction, operation, and maintenance practices.

 

5.  In 2001, City Council passed the City of Portland Green Building Policy (Resolution No. 35956) that requires green building practices be employed on all facilities projects constructed, owned or managed by the City; incorporates green building goals and practices into Portland Development Commission ongoing and future program areas; and promotes the voluntary applications of green building guideline in private sector building design, construction, and operations.

 

6.  To encourage the implementation of green building in Portland, the Office of Sustainable Development created an $800,000 Green Investment Fund to provide grants to private and non profit sector projects employing green building practices. The Green Investment Fund has four distinct grant areas: residential, commercial, technologies, and affordable housing.

 

7.  Through a competitive RFP process, the Office of Sustainable Development awarded REACH Community Development, Inc. a grant for the installation of a rainwater harvesting system and other green building measures at Station Place. The rainwater harvesting system includes a rooftop collection area, 20,000-gallon storage tank, water filtration equipment and plumbing, pumps and controls to provide rainwater for flushing 75 toilets; the system is estimated to save approximately 350,000 gallons of potable water per year and will demonstrate the costs and feasibility of rainwater harvesting on high-density residential projects. The grant totals $70,000 to be paid in two installments, $35,000 at the beginning of construction and the final $35,000 after final inspection of the system and the certificate of occupancy has been issued by the city. Funds in the current year are available in the General Fund, FY 2002-2003 Budget, Office of Sustainable Development, Center Code, 30230002, Account No. 549000.

 

NOW, THEREFORE, the council directs:

 

a.  The Commissioner of Public Affairs and Auditor are authorized to distribute a grant for the purpose described in Exhibit A of the contract in the amount of $70,000.

 

b.  The Director of the Office of Sustainable Development is authorized to provide individual grant of $70,000 to Reach Community Development, Inc. from the Green Investment Fund as described in Section 1, in accordance with specifications developed by the Office of Sustainable Development and City Attorney’s Office (see Attachment 1: ‘G/Rated Innovation in Affordable Housing’ Letter of Agreement).

 

c.  The Commissioner-in-charge and the Auditor are authorized to draw and deliver warrants in accordance with the contracts shown in Exhibit A.

 

d.  Increases in the total compensation payable to the Contractor must be approved by Ordinance of the Council.

e.  With the exception of amendments increasing the total compensation to the Contractor, amendments may be agreed to and executed by the Project Manager or her/his designee.

 

Section 2.  The Council declares that an emergency exists because payment is due to grant recipient. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
