ORDINANCE No. 177657

Extend deadline for Single Family New Construction Limited Tax Abatement applications for Rosemont Investment submitted prior to January 1, 2003 to receive final approval until December 31, 2003. (Ordinance)

The City of Portland ordains:

Section 1.  The Council finds that:

1.  On March 22, 1990 City Council passed Ordinance No. 16254 adopting new property tax exemption programs for owner-occupied residential rehabilitation and newly constructed single family housing in distressed areas.

2.  City Council passed Ordinance No. 176378 placing greater control over the program benefits, and emphasizing the homeownership purpose of the legislation.

3.  On March 12, 2003 City Council passed Ordinance No. 177317 granting an extension on construction completion until July 1, 2003. The ordinance further provided that the applications will automatically terminate unless before July 1, the applicant submits a request for extension and City Council determines on a factual basis that construction was not completed due to circumstances beyond control of the owner, and the owner can be expected to act in good faith and with due diligence.

6.  Both state statute and City Code allow City Council to extend the deadline for completion of construction for 12 months if an application was timely filed and City Council finds that construction was not completed due to circumstances beyond the owner’s control and that the owner had been acting and could reasonably be expected to act in good faith and with due diligence to complete construction.

NOW, THEREFORE, the Council directs:

1.  That the applicant and properties listed in the attached Exhibit A made timely application, and to facts asserted in Exhibit B Council finds construction was not completed by July 1, 2003 due to circumstances beyond their control and acted in good faith.

2.  That the applicant and the properties listed in Exhibit A are granted an extension on construction completion until December 31, 2003.

3.  That if an applicant has not completed construction by December 31, 2003, its application will automatically be terminated with no further extensions.
