ORDINANCE No. 177571

* Amend agreement with the Tri-County Metropolitan Transportation District of Oregon for design and construction management services for the North Interstate Light Rail project (Ordinance; amend Contract No. 51409)

The City of Portland ordains:

Section 1. The Council finds:

1.  In August 2000, by Ordinance No. 174777, Agreement No. 51409, the City Council authorized a Design and Construction Services Agreement (Agreement) between the Tri-County Metropolitan Transportation District of Oregon (TriMet) and the City of Portland (City) for the Interstate MAX Light Rail Project (Project).

2.  The purpose of the Agreement is to document each party’s understandings and agreements relating to the design and construction phases of the Project. Provision of services by the City, compensation, betterments, relocations, and Project policy and management are all detailed.

3.  The Project is under construction and a number of modifications must be made to the Agreement. The modifications are provided in the First Amendment (Amendment) to the Agreement. The Amendment clarifies construction work elements and responsibilities, modifies scopes of work, adds additional City services and betterments, and updates the budget information.

NOW, THEREFORE, The Council directs:

a.  The Commissioner of Public Utilities and the City Auditor are hereby authorized to execute on behalf of the City of Portland, the amendment to the Design and Construction Services Agreement with TriMet, in a form substantially similar to the form attached to the original of this Ordinance, and by reference made a part hereof.

Section 2. The Council declares that an emergency exists because a delay in the execution of the Amendment would impact billing and payment processes and unduly defer them to the following fiscal year; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
