ORDINANCE No. 177548

 

 

* Authorize Intergovernmental Agreements with Oregon Department of Transportation to provide pedestrian crossing improvements on SW Barbur Boulevard, SE 82nd Avenue, and N Lombard Street. (Ordinance)

 

The City of Portland ordains:        

 

Section 1.  The Council finds:

 

1.  The Oregon Department of Transportation (ODOT) Bicycle and Pedestrian Program has limited one-time funding of $1,000,000 through the Infrastructure Safety Improvement Program to improve safety at pedestrian crossings on state highways around Oregon.

 

2.  In November 2002, ODOT Solicited project proposals from local jurisdictions around the state for projects in the $30,000 - $75,000 range. Proposals were limited to median island and curb extension improvements.

 

3.  ODOT awarded the Portland Office of Transportation $321,000 to plan, design and construct pedestrian crossing improvements at:

•  SW Barbur Boulevard at SW Barbur Court

•  SW Barbur Boulevard at SW Alice Street

•  SW Barbur Boulevard at SW Taylors Ferry Road

•  SW Barbur Boulevard at SW Huber Street

•  SW Barbur Boulevard at SW Luradel Street

•  SE 82nd Avenue at SE Bybee Street or SE Glenwood Street or SE Knapp  Street

•  N Lombard Street at N Mississippi Avenue

 

 

4.  The Portland Office of Transportation will provide $29,000 in general transportation revenues from FY 03/04 as matching funds.

 

5.  The pedestrian crossing improvements on SW Barbur Boulevard are identified in the Barbur Boulevard Streetscape Plan, which was adopted by City Council on December 8, 1999.

 

6.  The three locations identified for the pedestrian crossing improvement on SE 82nd Avenue are identified in the Lents Town Center Urban Renewal Project Neighborhood Traffic Safety Plan.

 

7.  The proposed pedestrian crossing location on North Lombard Street was identified by TriMet and the Portland Office of Transportation in conjunction with planning for future TriMet service changes in the Interstate MAX area.

 

8.  The improvements shall be completed within 3 calendar years following the date of final execution of this agreement by both parties, and completion of final payments shall be no later than January 1, 2007, unless extended by a fully executed amendment.

 

9.  Oregon Department of Transportation has prepared seven agreements for City approval and execution.

 

NOW, THEREFORE, the Council directs:

 

a.  The Mayor and the Auditor are hereby authorized to enter into Intergovernmental Agreements with the Oregon Department of Transportation, similar in form to the agreements attached to the original of this ordinance, and by this reference made a part hereof.  

 

Section 2. The Council declares that an emergency exists because the agreements must be signed by all parties and executed by June 30, 2003, in order to receive the funds; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
