ORDINANCE No. 177382
* Accept a $20,000 grant from the Department of Environmental Quality for a recycling project at Portland State University (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City of Portland Council passed Ordinance number 171067, in April 1997, that set the City’s recycling goals at 54% in 2000 and 60% in 2005.
2. Portland City Code, Section 17.102.180 requires businesses to recycle 50% of their waste.
3. On September 12, 2002 the City Council adopted Ordinance No. 176893 which authorized an application to the Department of Environmental Quality (DEQ) for a pass-through grant to Portland State University (PSU).
4. Portland State University’s solid waste and recycling program does not meet the City’s recycling requirements.
5. The Department of Environmental Quality provides grants to local jurisdictions around the State. By law, the grants must go to local governments, but local governments may contract with community groups, private individuals, non-profit organizations, schools, businesses or chambers of commerce to implement grant-funded projects.
6. The City’s Solid Waste and Recycling Division will contract with the staff of PSU for $20,000 to implement a recycling program.
7. If the program is implemented, PSU expects to divert approximately 570 tons of recyclable material per year from the landfill and increase the university’s recycling rate to 41%.
8. No city match is required, but PSU will match in the amount of $62,100.
NOW, THEREFORE, the council directs:
a. The Mayor is hereby authorized to accept a $20,000 grant from the Department of Environmental Quality and sign an Agreement between Portland State University and the City of Portland.
b. The FY 2002-2003 Budget is hereby amended as follows:

Section 2. The Council declares that an emergency exists because delay in receiving grant funds, will cause delay in required programs. Therefore this Ordinance shall be in full force and effect from and after its passage by the Council.
