Resolution No. 36126
Authorize the City Attorney to petition the Oregon Court of Appeals for a determination of the validity of a state administrative rule regarding the urban growth boundary (Resolution)
WHEREAS, The Oregon Land Conservation and Development Commission adopted Oregon Administrative Rules Chapter 660, Division 026 relating to the urban growth boundary for the Portland metropolitan area; and
WHEREAS, This rule allows Metro to divide the metropolitan into subregions; and
WHEREAS, Any application of the rule could undermine further realization of the Downtown Plan and the Central City Plan that have made Portland a model of innovation, livability and revitalization known throughout the world; and
WHEREAS, The Oregon Court of Appeals is empowered to review the rule upon petition by the City of Portland;
NOW, THEREFORE, BE IT RESOLVED, that the City Attorney is authorized to petition the Oregon Court of Appeals to review OAR Chapter 660, Division 026, and the Bureau of Planning is authorized to provide any assistance the City Attorney may require.
