Extend contract with Murray, Smith and Associates, Inc. for professional engineering services (Ordinance; amend Contract No. 32776; waive Code Section 5.68)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The City entered into Contract No. 32776 with Murray, Smith and Associates, Inc. to provide professional services for design, permitting and assistance during construction for Stephenson Pump Station.

 

2.  Murray, Smith and Associates and the Water Bureau have completed 90% design plans and specifications. Completion of the work was delayed on this project due to budgetary constraints. The Bureau now requires completion of the design work and has allocated funds for construction to begin in FY 2003-2004. However, the contract time needs to be extended.

 

3.  The original contract expired September 30, 2001, and was not extended due to administrative error. Both parties (Water Bureau and Murray, Smith and Associates, Inc.) considered the contract to remain in effect and desire to further extend the contract now. Extending the contract with the original consultant will enable the Bureau to complete the work more efficiently, resulting in cost savings, and will also ensure that work is completed in time to meet requirements of the land use permit.

 

4.  Technical services are now needed through July 1, 2006.

 

5.  City Charter Section 2-105(a)(3) provides that non-property contracts shall not exceed five (5) years unless extended or renewed by City Council for up to an additional five (5) years. The initial five (5) year period for this contract expires January 4, 2005. In order to complete these needed services, it is necessary for City Council to authorize an extension of this contract through July 1, 2006.

 

6.  Any applicable provisions of PCC Section 5.68 must be waived for this contract and extension.

 

7.  All other terms and conditions of Contract No. 32776 remain the same.

 

NOW, THEREFORE, The Council directs:

 

a.  That the Commissioner of Public Affairs and Auditor are authorized to execute on behalf of the City an amendment to Contract No. 32776 between the City and Murray, Smith and Associates, Inc. as outlined in attached Exhibit 1, attached to original ordinance only.

 

b.  Agreement for Services with Murray, Smith and Associates, Inc. Contract No. 32776, dated January 4, 2000, is hereby retroactively extended from September 30, 2001 through July 1, 2006.

 

c.  In accordance with City Charter Section 2-105(a)(3), Council hereby exercises its option to extend and renew this contract and waives City Code Section 5.68.
