ORDINANCE No. 177222

 

    *Authorize Intergovernmental Agreement with the Housing Authority of Portland to perform Environmental Reviews for Hope VI Project to redevelop Columbia Villa (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The Housing Authority of Portland (HAP) received a Hope VI grant from the U.S Department of Housing and Urban Development (HUD) to redevelop Columbia Villa.

2.  Columbia Villa will be redeveloped as a vibrant mixed-income community that will provide services to stabilize lives, promote self-sufficiency, and link people to educational and recreational opportunities.

3.  The City of Portland and the HAP agree that there is a need for environmental review at the site and potential for contamination management prior to and during development.

4.  The HAP has requested that the City/BES provide environmental oversight, review, and management, as required.

5.  The City’s Bureau of Environmental Services (BES) has an existing agreement with Parametrix, Inc. for the execution of environmental reviews and contamination management.

6.  The HAP and the City of Portland have authority under ORS Chapter 190 to enter into an intergovernmental agreement.

7.  The established not to exceed cost is $250,000. Funds are available in the HAP budget. Payment will be made to Sewer System Operating Fund, FY 2002-03 Budget, Bureau of Environmental Services, Center Code 145-14-130, Project Number 7477, Account No. 529000.

 

 

NOW, THEREFORE, the council directs:

 

 a.  The Director of the Bureau of Environmental Services and Auditor are authorized to execute an intergovernmental agreement substantially in conformance with Exhibit A for the purpose described in Section 1, in the not to exceed amount of $250,000.

 

 b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

 

Section 2.  The Council declares that an emergency exists because HAP needs to commence construction by late summer 2003 to ensure use of the grant to redevelop this vital community resource. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
