ORDINANCE No. 177214

 

*Authorize the Purchasing Agent to sign an Intergovernmental Agreement with the Oregon Department of Administrative Services for membership in the Oregon Cooperative Procurement Program and provide for payment (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  Oregon State Statute 279.015 excepts from the requirements of competitive bidding, contracts made with other public agencies or the federal government.

 

2.  The same Statute provides an exemption from competitive bidding, contracts between public agencies utilizing an existing solicitation or current requirement contract of one of the public agencies that is party to the contract for which: a) the original contract met the requirements for competitive bidding, b) the contract allows other public agency usage of the contract, and c) the original contracting agency concurs.

 

3.  The State of Oregon Department of Administrative Services allows units of local governments, US Government agencies, Indian Tribes, qualified rehabilitation facilities, and certain other public benefit non-profit corporations to utilize existing State price agreements for equipment, materials and supplies, which the state has competitively bid and put under contract, through the Oregon Cooperative Procurement Program (ORCPP).

 

4.  The City of Portland finds significant value in participating in this program by taking advantage of the State’s ability to obtain very large volume discounts, and by reducing administrative costs in competitively bidding the same equipment and supplies as is offered under the ORCPP program.

 

5.  Participating agencies pay an administrative fee based on the agencies annual organizational budget and is $5,000 for the City.

 

 

NOW THEREFORE, the Council Directs:

 

a.  In accordance with City Code 5.33.030 C, the Purchasing Agent is hereby delegated authority to sign the annual Intergovernmental Agreement to participate in the Oregon Cooperative Procurement Program (ORCPP) for a period not to exceed five (5) years.

 

b.  The Mayor and the Auditor hereby are authorized to draw and deliver warrant(s) chargeable to the 2002-2003 Bureau of Purchases budget, when demand is presented, approved by the proper authorities.

 

 

Section 2.  The council declares that an emergency exists because a delay in proceeding with the agreement could result in additional administrative expense; therefore, this Ordinance shall be in full force and effect immediately after its passage by Council.
