ORDINANCE No. 177197
* Authorize a contract with Parsons Brinckerhoff Quade & Douglas, Inc. for professional design services and payment for the East Side Combined Sewer Overflow Tunnel, Project No. 5516 (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The combined sewer system routinely discharges combined sewage to the Willamette River.
2. The City has entered into an Amended Stipulation and Final Order (ASFO) with the Oregon Department of Environmental Quality to reduce combined sewer overflow discharges to the Willamette River.
3. The design and construction of the East Side CSO Tunnel is a necessary element of the City’s recommended CSO Management Plan to meet the ASFO.
4. The design of the East Side CSO Tunnel must be complete by December 1, 2006 to maintain compliance with the ASFO.
5. The consultant selection has been conducted in accordance with Chapter 5.68 of the Code of the City of Portland.
6. The consultant selection committee recommends that Parsons Brinckerhoff Quade & Douglas Inc. be retained to perform the required services.
7. The attached Agreement for Professional, Technical, or Expert Services (PTE) is for 18 months and is inclusive of production preliminary (30%) design documents for the East Side CSO Tunnel.
8. The attached Scope or Work and PTE Contract payment authorization is for only the preliminary (30%) design of the East Side CSO Tunnel.
9. The BES Project Manager will be requesting amendment of the contract and payment authorization for the completion of the project design (at the end of preliminary design) and for design services during construction.
10. The established cost is $4,544,432 . Funds are available in the Sewer System Operating Fund, FY 2002-03 Budget, Bureau of Environmental Services, Center Code 145-35-110, Project Number 5516, Account No. 521000.
NOW, THEREFORE, the council directs:
a. The Commissioner of Public Affairs and Auditor are authorized to execute a contract with Parsons Brinkerhoff Quade & Douglas, Inc. for the purpose described in Section 1, in the amount of $4,544,432.
b. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.
c. The Chief Engineer of the Bureau of Environmental Services is hereby authorized to execute change orders to increase the cost of the contract by up to 10 percent of the original amount.
Section 2. The Council declares that an emergency exists because delay in proceeding with the design of this project would jeopardize the City’s ability to meet the ASFO schedule. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
