ORDINANCE No. 177195

 

 

*Accept and authorize execution of easements for the West Side Combined Sewer Overflow Tunnel, Shafts, Pump Station and Pipeline Project granted by the Portland Development Commission and authorize total payment of $50,000. (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  Right-of-way is required for the construction of the West Side Combined Sewer Overflow (CSO) Tunnel, Shaft, Pump Station and Pipeline Project.

 

2.  The Portland Development Commission has conveyed the required rights-of-way to the City, for the total sum of $50,000.

 

3.  The City of Portland should now authorize execution of the easement.

 

NOW, THEREFORE, the Council directs:

 

a.  That the following described easement is hereby accepted for sewer shaft purposes:

 

 R/W #6075-2-Sh

 

A tract of land situated within Lots 5 and 6, Block 111, Portland, situated in the west one-half of Section 3, T1S, R1E, W.M., in the County of Multnomah and State of Oregon, more particularly described as follows:

 

Beginning at a point in the east line of Lot 5, Block 111, Portland, that is N 22°23'06" E, a distance of 39.84 feet from the southeast corner of said Lot 5; thence northwesterly along the arc of a 27.50 foot radius curve to the right, through a central angle of 197°13'05", an arc distance of 94.66 feet, (the chord bears N 22°23'06" E 54.38 feet) to a point in the east line of Lot 6, Block 111; thence S 22°23'06" W along the east line of Lots 6 and 5, a distance of 54.38 feet to the Point of Beginning.

 

Containing an area of 1,413 square feet or 0.0324 acres.

 

b.  That the following described easement is hereby accepted for sewer tunnel purposes:

 

R/W #6075-2-T

 

A portion of Block 112, Portland and vacated SW Columbia Street and vacated SW Clay Street, situated in the northwest one-quarter of Section 3, T1S, R1E, W.M., in the County of Multnomah and State of Oregon, more particularly described as follows:

 

Commencing at a point in the centerline of said SW Clay Street that is S 22°23'06" W, a distance of 30.00 feet from the southeast corner of Block 112, Portland; thence N 67°36'54" W along the centerline of said SW Clay Street, a distance of 160.00 feet to the Point of Beginning of the tract herein to be described; thence N 22°23'06" E, parallel with and 40.00 feet easterly, when measured at right angles, from the west line of Block 112, a distance of 260.00 feet to a point in the north line of that portion of SW Columbia Street vacated by Ordinance 152717; thence S 67°36'54" E along the centerline of said SW Clay Street, a distance of 0.88 feet; thence S 22°23'06" W parallel with the west line of said Block 112, a distance of 18.23 feet to a point of curvature; thence along the arc of a 980.00 foot radius curve to the left, through a central angle of 14°16'55", an arc distance of 244.28 feet, (the chord bears S 15°15'41" W 243.65 feet) to a point on the centerline of said vacated SW Clay Street; thence N 67°36'54" W along said centerline, a distance of 31.09 feet to the Point of Beginning.

 

Containing an area of 2,643 square feet or 0.0607 acres.

 

c.  The Director of the Bureau of Environmental Services is hereby authorized to execute the Sewer Shaft Easement and Sewer Tunnel Easement attached hereto and pay the consideration of $50,000.

 

d.  The Mayor and Auditor are authorized to draw a warrant in payment for the above described easements in the amount and in favor of the following:

 

Grantor:  Portland Development Commission      $50,000

 

Federal Taxpayer ID #: 93-6013584

 

said warrant to be charged to the Sewer System Operating Fund, Center Code 14522110, Project #6680, Account Code 567000; said warrant is to be delivered to the Right-of-Way Acquisition Section, Transportation Engineering and Development, Attn: Marcia S. Wilder (106/800).

 

e.  That the Right-of-Way Acquisition Section, Transportation Engineering and Development shall record in the appropriate deed records, documents of title as necessary for acquisition of these rights-of-way.

 

Section 2. The Council declares that an emergency exists because a delay in the acceptance of the easements might result in delays in the construction of the project; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
