ORDINANCE NO. 177194

 

 

* Contract with Portland Business Alliance for crime prevention services in the downtown area of the City for the period July 1, 2002 through June 30, 2003 and provide for payment (Ordinance; waive Code Section 5.68)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The City of Portland, through its Office of Neighborhood Involvement, wishes to provide crime prevention activities for its crime prevention program in the downtown area of the City by purchasing services from the Portland Business Alliance (PBA).

 

2.  PBA has replaced the Association for Portland Progress, with whom contracting for crime prevention services has occurred in the previous fiscal years.

 

3.  PBA is uniquely and solely qualified to provide the desired services in the manner and structure required.

 

4.  Necessary insurance certificates covering the period of the contract year are included in the attachment.

 

5.  Funds for the contract are included in the FY 2002-03 City budget.

 

 

NOW, THEREFORE, the Council directs:

 

a.  ONI shall issue a new contract with the Portland Business Alliance for the period July 1, 2002-June 30, 2003, and the requirements of 5.68 of City Code are hereby waived for said fiscal year.

 

b.  The Commissioner-in-charge and Auditor are authorized to execute on behalf of the City, a contract in the amount not to exceed $54,907 for the period July 1, 2002 through June 30, 2003 substantially in form with Exhibit A hereto attached and by this reference made a part hereof.

 

c.  The Commissioner-in-charge and the Auditor are authorized to draw and deliver warrants in accordance with the contracts shown in Exhibit A.

 

d.  Increases to the total compensation payable to the Contractor must be approved by Ordinance of the Council.

 

e.  With the exception of amendments increasing the total compensation to the Contractor, amendments may be agreed to and executed by the Project Manager or his/her delegatee.

Section 2.  The Council declares an emergency exists in order to avoid interruption in the continuity of services to be provided under this contract; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
