RESOLUTION No. 36116

 

 

Authorize the City Attorney and Bureau of Planning to participate in proceedings evaluating Metro’s compliance with certain periodic review work tasks before the Oregon Land Conservation and Development Commission and the Oregon Land Use Board of Appeals (Resolution)

 

WHEREAS,  The Oregon Land Conservation and Development Commission requires that urban land be used efficiently and that urban land be clearly distinguished from rural land through the establishment and maintenance of urban growth boundaries; and

 

WHEREAS,  On December 5, 2002, Metro adopted Ordinance No. 02-969B that would enlarge the urban growth boundary; and

 

WHEREAS,  Approximately 540 acres of land adjoining Portland’s Forest Park, known as Study Area 94, and parts of two similar sites known as Study Areas 89 and 93, would be included within the enlarged boundary; and

 

WHEREAS,  Study Areas 89, 93, and 94 were determined to be unsuitable and least suitable for urbanization by Metro’s studies of natural hazards, environmental values, availability and cost of urban services, and potential housing yield; and

 

WHEREAS,  Other land determined by these same studies to be suitable and more suitable for urbanization than Study Areas 89, 93, and 94 was not included within the enlarged boundary; and

 

WHEREAS,  Portland’s Mayor, Planning Director, and City Attorney participated in Metro’s hearings and advisory committees, and raised timely and substantive objections to the urbanization of unsuitable land, and to the untimely urbanization of least suitable land; and

 

WHEREAS,  On December 5, 2002 the entire Portland City Council signed a letter requesting Metro Council refrain from including Study Area 94 within the urban growth boundary; and

 

WHEREAS,  Metro Ordinance No. 02-969B will not become effective unless approved by the Oregon Land Conservation and Development Commission; and

 

WHEREAS,  The Oregon Land Conservation and Development Commission has established procedures through which the City of Portland may participate in the Commission’s review of Metro’s decision and assigning the review of related matters to the Oregon Land Use Board of Appeals; and

WHEREAS,  The City of Portland’s ability to participate in the review of Metro’s decision requires a timely filing of a written notice to the Oregon Department of Land Conservation and Development and the Oregon Land Use Board of Appeals;

 

 

 

NOW, THEREFORE, BE IT RESOLVED, that the City Attorney and the Bureau of Planning are authorized to participate in the review of Metro’s completion of certain periodic review work tasks, specifically Metro Ordinance No. 02-969B, by the Oregon Department of Land Conservation and Development, and if necessary, by the Oregon Land Conservation and Development Commission or the Oregon Land Use Board of Appeals, including filing any notices, objections, or other comments necessary to express the City of Portland’s opposition to the inclusion of Study Areas 89, 93, and 94 within an expanded urban growth boundary.
