* Authorize Intergovernmental Agreement with the City of Gresham for the Johnson Creek Watershed Reforestation Project (Ordinance)
The City of Portland ordains:
Section 1. The Council finds that:
1. Johnson Creek is listed by the Oregon Department of Environmental Quality for summer water temperatures that exceed thresholds for cold water fish species, including salmonids; and,
2. Most of the historic floodplain forest has been removed from Johnson Creek, contributing to stream temperatures increases and loss of aquatic habitat; and,
3. Project areas under the proposed Agreement are listed under the federal Endangered Species Act for endangered salmonids; and,
4. Riparian revegetation and tree planting is the most cost effective and ecologically sound alternative to reduce summer water temperatures; and,
5. Temperature modeling has indicated that planting native trees and shrubs in the proposed locations will lower summer stream temperatures as a major part of compliance with Oregon Department of Environmental Quality standards; and,
6. At the 1998 Johnson Creek Summit, citizens specifically asked for inter-governmental cooperation in managing and restoring Johnson Creek; and,
7. Intergovernmental coordination at the staff level will assist public agencies in writing more effective grants and bringing new funding sources into watershed protection; and
8. The City of Portland Bureau of Environmental Services Watershed Revegetation Program (“WRP”) staff have local expertise in riparian revegetation for the purpose of improving watershed health; and,
9. WRP has negotiated over 140 agreements with landowners for revegetation over the last six years; and,
10. Collaborating on reforestation efforts, and contracting with WRP to supervise revegetation efforts in Gresham in collaboration with Portland efforts will be more cost-effective for each jurisdiction, due to the larger economy-of-scale when purchasing plant material and contracting for labor, machinery, and other specialized revegetation prescriptions; and
11. Specific plant material appropriate for Johnson Creek revegetation sites is available through WRP; and,
12. Portland and Gresham acknowledge that they have the authority to enter into this Agreement pursuant to the powers contained in their respective charters and in ORS 190.010.
NOW, THEREFORE, the Council directs:
a. The Mayor is hereby authorized to enter into an Inter-Governmental Agreement between City of Portland and City of Gresham in the amount of $150,380 for the purpose of Johnson Creek reforestation.
b. The FY 02/03 budget is hereby amended as follows:

Section 2. The Council declares that an emergency exists because a delay in proceeding with this project could delay completion of the project on schedule. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
