ORDINANCE NO. 177174
*Amend contract with Adolfson Associates Inc. for planning services to increase the amount to $25,000 and extend the termination date to June 30, 2003 (Ordinance; amend Contract No. 34388)
The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Development Services is responsible for implementing the City’s land division and environmental review procedures, as described in Title 33, Planning and Zoning. The Bureau of Development Services is required under City Code and State Statute to make land use review decisions in a timely manner.
2. In July of 2002 a new land division code went into effect (The 600-Series of Title 33), and the previous land division code (Title 34) was repealed, pursuant to Ordinance #175965. As a result, the Bureau of Development Services received an unusual number of Title 34 land division applications in June of 2002. Many of these applications were incomplete, and are still being processed.
3. The Bureau of Development Services employs several full time planners with an environmental specialty to carry out the City’s environmental review function (Chapter 33.430). One of those planners left the City in July of 2002. The Bureau of Development Services has not filled the subsequent vacancy. As a result, the environmental team has been operating with fewer staff.
4. On October 21st, 2002 the Bureau of Development Services received a land use review application from the Port of Portland for a Conditional Use Master Plan for the Portland International Airport. The Zoning Code includes a requirement for environmental analysis as part of this Master Plan review (Chapter 33.815).
5. Adolfson Associates, Inc. was hired to provide professional planning services related to implementing the City’s land division (Title 34) and environmental review process (Title 33, Chapter 430). Since September of 2002 Adolfson Associates Inc. has helped the Bureau of Development Services to reduce the land use review backlog that resulted from the July 2002 code changes and unfilled vacancies. The current contract is limited to $20,000 and will expire on December 31st, 2002.
6. The Bureau of Development Services is in the process of filling the vacancy on the land division and environmental team. Once hired, staff time will have to be allocated to training the new employee. During this time there is a need to have additional environmental analysis capacity available to the team. The additional capacity provided by Adolfson Associates Inc. will help ensure that the bureau can meet code-mandated deadlines for the remaining Title 34 land division cases, ongoing environmental review applications, and the Airport Master Plan application.
7. The Bureau of Development Services complied with all City Code Title 5 procedures for awarding professional, technical and expert services contracts to Adolfson Associates Inc. It is appropriate to extend the existing contract to provide for continued services, and to increase compensation to the contractor in the amounts indicated below.
8. The agreement with Adolfson Associates, Inc. is authorized to be extended from December 31st, 2002 to June 30th, 2003.
9. The cost to extend this contract and provide for additional services through June 30th, 2003 is $5,000.
NOW, THEREFORE, the Council directs:
a. The Mayor and the Auditor are hereby authorized to execute the contract amendments attached as Exhibit A between the City of Portland, Bureau of Development Services and Adolfson Associates, Inc. in the additional amount of $5,000 (new total contract amount not to exceed $25,000).
b. The Mayor and the Auditor hereby are authorized to draw and deliver a warrant chargeable to the Bureau of Development Services Budget (52070001), when demand is presented and approved by the proper authorities.
b. For Adolfson Associates, Inc. this agreement is authorized and extended from December 31st 2002 through June 30th, 2003, in accordance with the attached amendment forms (Exhibit A).
Section 2. The Council declares an emergency exists because land use reviews must be completed in a timely manner; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
