ORDINANCE NO. 177172

Amend contract with Montgomery Watson Harza Energy and Infrastructure, Inc., for an amount not to exceed $300,000, to provide professional engineering design services and construction support for Phases II and III of the Dam 2 Tower Improvement Project. (Ordinance; amend Contract No. 32984)

The City of Portland ordains:

Section 1. The Council finds:

1.  The Bureau of Water Works requires professional services to develop complete plans and specifications for modifications and improvements at the Dam 2 Towers (Phase II).

2.  The Bureau of Water Works requires Construction support and special inspection services during the bidding process and construction of the modifications and improvements at the Dam 2 Towers (Phase III).

3.  The original selection allowed for the addition of Phases II and III to the existing contract as added services, if required.

4.  In FY 1999-00 the Bureau of Water Works entered into an agreement with Harza Engineering Company, Inc., now Montgomery Watson Harza Energy and Infrastructure, Inc., for $220,000. Amendment No.1 increased this contract to $252,000.

5.  The cost of services for Phases II and III is not to exceed $300,000.

6.  The Bureau of Water Works’ FY 2002-03 and 2003-04 Budgets include funds for this project’s design and construction phases.

NOW, THEREFORE, The Council directs:

a.  That the Commissioner of Public Affairs and Auditor are authorized to execute on behalf of the City an amendment to Contract No. 32984 with Montgomery Watson Harza Energy and Infrastructure, Inc. for an additional cost not to exceed $300,000 for the period ending June 30, 2005, as outlined in Exhibit A, attached herein.

b.  The Mayor and the Auditor hereby are authorized to draw and deliver warrants chargeable to the FY 2002-03 and 2003-04 budget, Water Fund, Bureau of Water Works, Center Code No. 18089908, project 3364 (formerly No. 3136), Account 521000 when demand is presented and approved by the proper authorities.

c.  The Chief Engineer of the Water Bureau is hereby authorized to increase the cost of the contract up to 10% of the amount of this amendment as stated in paragraph (a) and to extend the contract time as necessary.
