ORDINANCE No. 177169

 

Authorize the Director of the Bureau of Environmental Services to enter into an agreement to settle outstanding matters in condemnation actions for the Southwest Parallel Interceptor Project (Ordiance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

1.  The Southwest Parallel Interceptor Project required the City to condemn certain easement interests in property along the alignment.

2.  The City Attorney filed condemnation cases to acquire some easements and has negotiated a settlement of those cases that is fair and reasonable.

NOW, THEREFORE, the Council directs:

 

a.  The Director of the Bureau of Environmental Services is authorized to sign a Sewer Easement in substantially the form of Exhibit A, attached hereto.

b.  The Mayor and Auditor are hereby authorized to draw a warrant payable to EOP-River Forum, LLC, in the amount of $77,615.00, chargeable to Center Code 14522110 (funds are available for Project No. 5502TW71).

Section 2.  The Council declares that an emergency exists because a delay in authorizing this settlement will delay recording the easements acquired for the project; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
