ORDINANCE NO. 177168
Amend Bureau of Water Works water rates for FY 2002-03 to include a commodity rate for a service supplied solely by the assets of the Columbia South Shore Wellfield alone (Ordinance; amend Ordinance No. 176525)
The City of Portland ordains:
Section 1. The Council finds:

1. The Bureau of Water Works wishes to enter into a business agreement whereby it would use the Columbia South Shore Wellfield to supply water for sale to the National UV Validation Facility, operated by Carollo Engineers.
2. The Bureau of Water Works recognizes that no System Development Charge is associated with the supply of this water.
3. The Bureau of Water Works stipulates that this water supply is an interruptible supply subject to curtailment, with reasonable notification, by the Administrator of the Bureau of Water Works to address the normal priority operations, pilot testing, construction activities and/or emergency supply requirements of the Groundwater system.
4. The Bureau of Water Works agrees to lease certain space, on its properties in the Columbia South Shore Wellfield, to Carollo Engineers for siting of the National UV Validation Facility.
5. A rate of $0.35 per hundred cubic feet of water will be charged, based on the use of the Columbia South Shore Wellfield assets, including operations, maintenance and capital costs associated with the provision of water. Any incremental costs or administrative fees incurred by the City to provide services other than the provision of water, e.g., design, permitting, etc., will be added to the costs determined above at rates agreed to in the property lease agreement.
6. All other terms and conditions of this ordinance remain the same.
NOW, THEREFORE, The Council directs:
a. That the Commissioner-in charge of the Bureau of Water Works is authorized to execute, on behalf of the City, an amendment to Ordinance No. 176525 to include a commodity charge for water supplied to the National UV Validation Facility. The amendment to the Ordinance, as outlined in Exhibit A, attached herein, is for the Fiscal Year 2002-03.
b. That the Administrator and Chief Engineer of the Bureau of Water Works are authorized to execute a lease agreement with Carollo Engineers for the use of the properties and the sale of water. (Attached to the original only)
Section 2. The Council declares that an emergency exists because a delay in proceeding with this amendment will result in the delay of the finalization of the lease agreement and, consequently, in the inaugural testing at the national UV Validation Facility.
