ORDINANCE NO: 177161

*  Amend Contract with Don Ganer & Associates to increase contract amount by $3,200 for additional scope of work and extend completion date to June 30, 2003. (Ordinance; amend Contract No. 33190)

The City of Portland ordains:

Section 1. The Council finds:

1.  On August 23, 2000, by Ordinance No. 174766, Portland Parks and Recreation entered into Contract #33190 (“Contract”) with Don Ganer & Associates (“Consultant”) to evaluate the sufficiency of the Parks System Development Charge Program.

2.  On January 29, 2001, by Ordinance No. 175268 Council approved Amendment 1 to Contract with Consultant expanding scope of work, extending contract time to March 31, 2002, and adding $777 to Contract for a total Contract amount of $28,527.

3.  On December 27, 2001, Director of Parks executed Amendment 2 to Contract to extend Contract time to December 31, 2002.

4.  Portland Parks and Recreation requires Consultant to perform additional work tasks consistent with the original scope of work as described in Exhibit A (Amendment 3 to Contract) and add $3,200 to Contract for a total Contract amount of $31,727.

5.  Portland Parks and Recreation requires that the contract time be extended to June 30, 2003.

6.  Funds for this agreement will be drawn from Parks and Recreation SDC Account 76610100.

NOW, THEREFORE, The Council directs:

a.  The Mayor and Auditor are authorized to provide for payment chargeable to the applicable budget when demand is presented and approved by the appropriate authorities;

b.  The Commissioner of Public Utilities or, in his absence, the Mayor and the Auditor are hereby authorized to approve Amendment 3 to Contract No. 33190 adding additional work tasks, increasing contract amount by $3,200, and extending the completion date on Contract No. 33190 with Don Ganer & Associates to June 30, 2003;

Section 2. The Council declares that an emergency exists because delay would force expiration of Contract and adversely affect timely performance of Contract work; therefore, this ordinance shall be in full force and effect after its passage by Council.
