ORDINANCE 177158

*Extend contract with Miller, Nash LLP for outside legal counsel (Ordinance, amend Contract No. 34146)

The City of Portland ordains:

Section 1. The Council finds:

1.  The City required the services of outside legal counsel to assist in trial of the case of City of Portland v. Boeing.

2.  The law firm of Miller, Nash, LLP, (Counsel) agreed to provide these services by Legal Service Agreement No. 34146.

3.  Due to the complexity of the issues and the magnitude of the case, expenditures for outside counsel have exceeded that previously authorized by Council. It is necessary to extend the legal services agreement in the amount of $255,000 in order to authorize and continue payment.

NOW, THEREFORE, the Council directs:

a.  The City Attorney is authorized to extend Legal Service Agreement No. 34146, dated April 11, 2002, to provide for representation by outside counsel in an additional amount of $255,000.

b.  If applicable, the provisions of City Code Chapter 5.68 are waived.

c.  The Mayor and Auditor are authorized to draw and deliver warrants in payment of legal services provided under this Legal Services Agreement chargeable to Center Code 18089961/ Project #3457/Account No. 521000.

Section 2. The Council declares that an emergency exists in order to pay for legal services necessary in the matter of City of Portland vs. Boeing, therefore, this ordinance shall be in full force and effect from and after its passage by Council.
