ORDINANCE NO. 177156
*Extend contract with Miller & Van Eaton for specific legal expertise (Ordinance; amend contract no. 33776)
The City of Portland ordains:
Section 1. The Council finds:
1. Due to a need for specific legal expertise, the City required the services of outside legal counsel to provide advice on legal issues pertaining to challenges against City Charter and City Code regulations brought by Qwest Corporation.
2. The law firm of Miller & Van Eaton, (Counsel) agreed to provide these services by Legal Services Agreement No. 33776, dated August 03, 2001.
3. Due to the complexity of the issues and the magnitude of the case, expenditures for outside counsel will exceed that previously authorized by Council. It is necessary to extend the legal services agreement in the amount of $75,000 in order to authorize and continue payment
NOW, THEREFORE, the Council directs:
a. The City Attorney is authorized to extend Legal Service Agreement No. 33776, dated August 03, 2001 to provide for representation by outside counsel in an additional amount of $75,000.
b. If applicable, the provisions of City Code Chapter 5.68 are waived.
c. The Mayor and Auditor are authorized to draw and deliver warrants in payment of legal services provided under this Legal Services Agreement.
Section 2. The Council declares that an emergency exists in order to pay for legal services necessary in the matter of Qwest Corporation v. City of Portland, therefore, this ordinance shall be in full force and effect from and after its passage by Council.
