ORDINANCE No. 177155
*Pay Claim of William B. Strauss. (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. William B. Strauss has filed a claim against the City for damages suffered in an accident involving the Portland Department of Transportation on September 02, 2002.
2. The claim has been investigated by the Risk Management Division. Investigation indicates there is risk the City may be found liable. Therefore, in order to avoid the risk of a large jury award, we feel it is prudent to compromise the auto property damage claim at this time.
3. The Risk Management Division recommends the auto property damage claim be compromised for $6,705.81, subject to the claimant providing the City with a release in a form to be approved by the City Attorney. Risk Management has previously advanced $500.00 for the deductible to the claimant William B. Strauss.
NOW, THEREFORE, the Council directs:
a. The Mayor and the Auditor are hereby authorized to draw and deliver a check in the amount of $6,705.81 made payable to Mid-Century Insurance Company. Total claim settlement is $7,205.81.
b. The Risk Management Division will execute a payment authorization in the amount set forth in sub-paragraph (a) above.
Section 2. The Council declares that an emergency exists in order to avoid undue and costly delay in settling this auto property damage claim; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
