ORDINANCE No. 177881

 

* Amend the Comprehensive Plan Map designations and change zoning designations at Columbia Villa (Ordinance: LU 03-118615 LDS CP ZC AD)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The Applicant seeks, within the area commonly referred to as Columbia Villa, the following:

 

a.  a Comprehensive Plan Amendment to relocate certain identified property designated as Low-Density Multi-Dwelling to Urban Commercial (an area of 138,751 square feet) and relocate certain identified real property designated as Urban Commercial to Low-Density Multi-Dwelling (an area of 139,679 square feet); and

 

b.  a Comprehensive Plan Amendment to re-designate from Industrial Sanctuary to Low-Density Multi-Dwelling (an area of 2,974 square feet; and

 

c.  a Comprehensive Plan Amendment to re-designate from High-density Single-Dwelling to Low-Density Multi-Dwelling (an area of 5,590 square feet); and

 

d.  a Zone Change to relocate from R2 zoning to CS zoning (an area of 138,751 square feet) and from CS zoning to R2 zoning (an area of 139,679 square feet); and

 

e.  a Zone Change to re-designate from IG2 zoning to R2 zoning (an area of 2,974 square feet); and

 

f.  a Zone Change to re-designate from Residential 5,000 (R5) zoning to Residential 2,000 (R2) zoning (an area of 5,590 square feet).

 

2.  An application complying with all requirements of Title 33, Planning and Zoning, of the Code of the City of Portland seeking amendment of the Comprehensive Plan Map and Zoning Map has been received with the proper fee for filing paid.

 

3.  A duly noticed public hearing was held on July 15, 2003 and a Recommendation and Decision of the Hearings Officer was issued on July 30, 2003 (BDS File No. LU 03-118615 LDS CP ZC AD). A decision approving the proposed subdivision and adjustments was made by the hearings officer and a recommendation of approval was made to the City Council regarding the Comprehensive Plan Map amendments and Zoning Map amendments.

 

4.  The requested amendments to the Comprehensive Plan Map and Zoning Map, based on the findings contained in the Recommendation and Decision of the Hearings Officer, are found to be in conformance with the Comprehensive Plan and relevant Title 33 approval criteria.

 

NOW, THEREFORE, the Council directs:

 

a.  That the facts, findings, conclusions and recommendation of the Hearings Officer in BDS File No. LU 03-118615 LDS CP ZC AD are adopted by City Council.

 

b.  The Comprehensive Plan Map and Zoning Maps are amended as described below. The property subject to each amendment is described below, and illustrated with Exhibits C.20 (existing) and C.21 (proposed) of land use review case number LU 03-118615 LDS CP ZC AD. The descriptions below reference the approved preliminary plan for the New Columbia subdivision, which is illustrated with Exhibit C.1 of land use review case number LU 03-118615 LDS CP ZC AD.

 

1.  A Comprehensive Plan Map Amendment to re-designate 138,751 square feet from Low–Density Multi-Dwelling to the Urban Commercial; and re-designate 139,679 square feet from Urban Commercial to Low–Density Multi-Dwelling. The result of this amendment is that Lots 182, 183, 197, and 301 of the approved preliminary plan for the New Columbia subdivision shall be designated Urban Commercial; and Lots 181, 184, and 185 of the approved preliminary plan for the New Columbia subdivision shall be designated Low–Density Multi-Dwelling.

 

2.  A Comprehensive Plan Map Amendment to re-designate a 2,974 square foot area from Industrial Sanctuary to the Low –Density Multi-Dwelling. The property subject to this amendment corresponds to the portion of the Columbia Villa site that is north of the centerline of the N. Fessenden St. right of way (as projected west into the site from the abutting undeveloped right of way), and east of the centerline of the N. Dana Ct. right of way (as projected south into the site from the abutting undeveloped right of way). The result of this amendment is that Lots 278 and 279 of the approved preliminary plan for the New Columbia subdivision shall be designated Low–Density Multi-Dwelling.

3.  A Comprehensive Plan Map Amendment to re-designate an area of 5,590 square feet from High-Density Single-Dwelling to Low –Density Multi-Dwelling. The property subject to this amendment corresponds to the southern portions of tax lots 1N1E08BD 100 and 1N1E08AC 4700. The result of this amendment is that the entire area of these taxlots shall be designated Low–Density Multi-Dwelling.

4.  A Zoning Map Amendment to re-designate 138,751 square feet from the Residential 2,000 (R2) to Storefront Commercial (CS); and re-designate 139,679 square feet from Storefront Commercial (CS) to Residential 2,000 (R2). The result of this amendment is that Lots 182, 183, 197, and 301 of the approved preliminary plan for the New Columbia subdivision shall be designated Storefront Commercial (CS); and Lots 181, 184, and 185 of the approved preliminary plan for the New Columbia subdivision shall be designated Residential 2,000 (R2).

 

5.  A Zoning Map Amendment to re-designate a 2,974 square foot area from General Industrial 2 (IG2) to Residential 2,000 (R2). The property subject to this amendment corresponds to the portion of the Columbia Villa site that is north of the centerline of the N. Fessenden St. right of way (as projected west into the site from the abutting undeveloped right of way), and east of the centerline of the N. Dana Ct. right of way (as projected south into the site from the abutting undeveloped right of way). The result of this amendment is that Lots 278 and 279 of the approved preliminary plan for the New Columbia subdivision shall be designated Residential 2,000 (R2).

6.  A Zoning Map Amendment to re-designate an area of 5,590 square feet from Residential 5,000 (R5) to Residential 2,000 (R2). The property subject to this amendment corresponds to the southern portions of tax lots 1N1E08BD 100 and 1N1E08AC 4700. The result of this amendment is that the entire area of these taxlots shall be designated Residential 2,000.

c.  No change shall be made to the zoning maps until the effective date of this ordinance.

 

Section 2. The Council declares an emergency exists because there should be no delay in the beneficial use of the above-described property; therefore this ordinance shall be in force and effect from and after its passage by the Council.
