ORDINANCE No. 177146
* Amend Ordinance for real estate and environmental management services in support of capital improvement projects to increase spending authority to cover unanticipated Citywide increases in service requests (Ordinance; amend Ordinance No. 175309)
The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Environmental Services (BES) requires professional services for technical support of real estate, and construction activities conducted in association with the Bureau’s CSO, watershed, stormwater, and other capital projects.
2. These services include land appraisals, surveys, title reports, site searches, environmental site assessments, laboratory services, remedial action plan development and wetlands delineation and determination. The external services are managed, and supplement contamination management programs provided by Coordinated Site Assessment (CSA) staff in the BES Special Waste Division.
3. The establishment of annual requirements contracts based upon estimated amounts of work without a specific City commitment to purchase any given amount of service is in the best interests of the City to accomplish these tasks at competitive rates within the time required.
4. Annual requirement contracts for these services facilitate long range planning, increase control, and provide for an uninterrupted supply of needed services within the CIP schedule.
5. Contracting for professional, technical and expert services in this method represents an innovative, cost-effective method of service procurement without compromising the Code requirements for competition and minority and women-owned business outreach.
6. Benefits from the CSA program have exceeded expectations in cost savings, improved product quality and time utility, and general management control.
7. Requests for CSA services have increased at a pace unanticipated when Ordinance No. 175309 for the supplemental professional services was initiated. The program currently serves Citywide through interagency and other agencies through intergovernmental agreements.
8. The increased magnitude and volume of projects requesting CSA environmental/contamination management services requires that the annual $750,000 spending authority for the external professional services, as defined in Ordinance No. 175309, be increased to a new total not to exceed $1,200,000.
9. All other terms and conditions of Ordinance No. 175309 remain the same.
10. For BES work, funds are available in the Sewer System Operating Fund, FY 2002-2003 Budget and will be requested annually, Bureau of Environmental Services, Centercode 145-22-110. Funds are provided from various CIP projects within that centercode. For other bureau/agency work, funds will be provided (BES reimbursed) through Agreements with BES and the City.
NOW, THEREFORE, the council directs:
a. The Bureau Director and Auditor are authorized to execute contracts with the firms listed in Ordinance No. 175309, for services described in Section 1, in an amount not to exceed in total $1,200,000 annually.
b. The Mayor and Auditor are authorized to provide for payment chargeable to the applicable budgets when demand is presented and approved by the appropriate authorities.
Section 2. The Council declares that an emergency exists because a delay in proceeding with these contracts could result in additional expense to the City. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
