ORDINANCE No. 177141

 

*  Authorize acceptance of donation of a tract of land from Dirk and Diane Koopman, et al (Grantors) for property contiguous to the Marquam Nature Park. (Ordinance)

The City of Portland ordains:

Section 1. The Council Finds:

 

1.  Dirk and Diane Koopman, et al, (Grantors) have offered to donate a tract of land contiguous to Marquam Nature Park in Southwest Portland to the City of Portland (Grantee).

 

2.  The property is a 0.98 Acre tract of land located within the northwest quarter of Section 9, Township 1 South, Range 1 East, Willamette Meridian, Multnomah County, Oregon more particularly described and shown on Exhibit A, attached to this Ordinance (“Property”).

 

3.  Portland Parks and Recreation (“Parks”) has determined that significant passive recreation and wildlife habitat benefits will occur as a result of the City’s acceptance of this tract of land, and that this is in the public interest for the general benefit and use of the City of Portland.

 

4.  The Director of Parks estimates that accepting the property will result in one-time property stabilization costs of $12,000 and on-going maintenance cost will be $3,600 per year. The one-time costs will be charged to the Parks SDC Program. There is sufficient capacity I the General Fund O & M set-aside for the on-going costs.

 

 

NOW, THEREFORE, The Council directs that:

 

a.  The Commissioner of Public Utilities, or in his absence the Mayor, is authorized to execute the acceptance of the donation of land, substantially represented by Exhibit B attached to this Ordinance, and all other documents necessary to complete the transaction once approved as to form by the City Attorney;

 

b.  The Director of Parks is directed to add the Property to the City’s natural area park inventory, perform one-time site stabilization work chargeable to the Parks SDC Program, and to manage and maintain the site for the general benefit and use of the City of Portland ; and

 

c.  In accepting responsibility for this natural area, the Council acknowledges the need to fund the on-going maintenance costs. The Office of Finance and Administration is directed to transfer $3,600 to the Park’s on-going budget target effective FY2003-04 to pay the on-going maintenance expenses.

Section 2. The Council declares that an emergency exists because the Grantors’ offer of donation is limited by time and delay would prevent the donation from being granted, now; therefore, this ordinance shall be in full force and effect after its passage by Council.
