ORDINANCE No. 177140

 

*Amend Interagency Agreement with the Portland Development Commission for

2002 – 2003 professional and technical services for transportation improvements (Ordinance; amend Contract No. 51819)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  On July 3, 2002, City Council passed Ordinance 176642 authorizing an interagency agreement for FY 2002-2003 for professional and technical services for transportation projects in urban renewal areas.

 

2.  On August 28, 2002, City Council passed Ordinance 176873 amending the interagency agreement with the Portland Development Commission (PDC) for FY 2002-2003 authorizing four additional scopes of work.

 

3.  On October 30, 2002, City Council passed Ordinance 177005 amending the interagency agreement with PDC for FY 2002-2003 authorizing four additional scopes of work.

 

4.  On December 11, 2002, the Portland Development Commission passed a Resolution adding and modifying two scopes of services for the Lents Town Center Urban Design Plan, and the Harrison Street Connector Preliminary and Final Engineering Design.

 

5.  The Portland Office of Transportation (PDOT) and PDC wish to add the work requested by the Portland Development Commission to the Interagency Agreement and to increase the total compensation to PDOT to an amount not to exceed $7,230,152.

 

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner of Public Utilities and the Auditor are hereby authorized to amend Interagency Agreement No. 51819, similar in form to the agreement attached to the original of this Ordinance, and by this reference made a part hereof.

 

b.  The Bureau Contract Manager is authorized to agree to and execute on behalf of the City, any amendment which does not increase the total compensation under this agreement or change the length of the contract period with the mutual consent of the PDC contract manager.

 

Section 2. The Council declares that an emergency exists because a delay in executing this Interagency Agreement will adversely impact the City’s ability to meet the design and construction schedule for the included projects; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
