ORDINANCE No. 177139

*Amend agreement with Oregon Department of Transportation for Bikeway/Walkway Project connecting SW Custer Street to SW Fourth Avenue. (Ordinance; amend Contract No. 51451)

The City of Portland ordains:        

Section 1.  The Council finds:

1.  On November 28, 2000, the City of Portland (City) entered into an agreement with the Oregon Department of Transportation (ODOT) for the funding, design and construction of a multi-use path between SW Custer Street and SW Fourth Avenue (Ordinance No. 174519, Agreement No. 17729).

2.  On October 8, 2002, the City and ODOT amended the agreement to revise the project end date, to provide additional project information and to revise the project cost and state contribution to $20,000 (Ordinance No. 176761, Agreement No. 17729 Amendment 1).

3.  A second amendment to the original agreement has been prepared to revise a construction element and extend the project completion date to December 31, 2003.

4.  There is not a match requirement for these funds. ODOT will reimburse up to the amount of the amended agreement with funds from the State Highway Trust Fund; no Federal funding is involved.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities and the Auditor are hereby authorized to enter into Amendment No. 2 to Agreement No. 17729, similar in form to the amendment attached to the original of this ordinance, and by this reference made a part hereof.

Section 2. The Council declares that an emergency exists because the existing agreement expires on December 31, 2002, and a delay in executing this amendment would affect the City’s ability to deliver the completed project on time; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
