ORDINANCE No. 177138

* Authorize Intergovernmental Agreement with the Oregon Department of Transportation to provide funding for construction for the Capital Highway, Vermont Street Bertha Court Improvement project. Ordinance)

The City of Portland ordains:        

Section 1.  The Council finds:

1.  The City of Portland Office of Transportation (City) is completing the design for a bike and pedestrian safety improvement on Bertha Court in the Hillsdale Town Center area. The project will add a north-bound bike lane and pedestrian sidewalk on Bertha Court between Vermont and Capital Highway.

2.  The project will be managed by the City and administered through the Oregon Department of Transportation (ODOT) as part of a Transportation Enhancement Program (TEA-21).

3.  The total cost of the project is estimated at $619,250.

4.  $400,000 is being funded through the TEA-21 federal funding program and is to be used for the construction portion of the project.

5.  Federal funds will cover 80% of the construction costs for this project. The City’s share of the match and any other non-participating costs will be included in Transportation System Development Charge funds.

6.  Funds for the match requirement are budgeted in FY 02/03 for the Bureau of Transportation Engineering and Development.

7.  Construction is scheduled for the summer of 2003.

NOW, THEREFORE, the Council directs:

a.  The Mayor and the Auditor are hereby authorized to enter into an Intergovernmental Agreement with the Oregon Department of Transportation, similar in form to the agreement attached to the original of this ordinance, and by this reference made a part hereof.

Section 2.  The Council declares that an emergency exists because delay in executing this agreement will delay design and construction of these improvements; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
