ORDINANCE No. 177136

 

*Amend Intergovernmental Agreement with the City of Milwaukie for construction of the Johnson Creek Boulevard Street Improvement Project. (Ordinance; amend Contract No. 51139)

 

The City of Portland ordains:        

 

Section 1.  The Council finds:

 

1.  The Southeast Corridor Plan, adopted by Council in 1989, recommended construction of bike lanes and sidewalks on Johnson Creek Boulevard, but did not recommend additional transportation capacity.

 

2.  Since 1993, the Cities of Portland and Milwaukie have been working closely with affected residents on Johnson Creek Boulevard in developing the Johnson Creek Boulevard Improvement Project which will add bicycle lanes and sidewalks to Johnson Creek Boulevard from SE 32nd to SE 45th Ave. The current project is the third phase from SE 36th to SE 45th.

 

3.  The Bureau of Transportation Engineering and Development has been responsible for design and construction of the project. The project is funded with federal funds with a proportional local match share paid by each city.

 

4.  The City of Milwaukie and the Portland Office of Transportation entered into Intergovernmental Agreement No. 51139 on February 18, 1999, to construct the project which covers Phase 2 and 3 funding, improvements, and responsibilities of the parties on Johnson Creek Blvd from SE 36th to Johnson Creek.

 

5.  In the past two years and the current fiscal year (2002-03), an additional $1,912,000 in federal funding has become available for a total amount of $2,712,000, with the required local match fund sufficient to proceed with completion of the project according to updated cost estimates.

 

6.  The Portland Office of Transportation and the City of Milwaukie therefore wish to amend Agreement No. 51139 to update provisions needed to complete the Project.

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner of Public Utilities and the Auditor are authorized to sign an amended Intergovernmental Agreement with the City of Milwaukie, similar in form to the agreement attached to the original of this ordinance and by this reference made a part hereof, to provide for construction of the Johnson Creek Boulevard Transportation Improvement Project.

 

Section 2.  The Council declares that an emergency exists because delay in completing this agreement could result in a delay in the construction of the project; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
