* Authorize agreement with Motorola to upgrade the public safety radio system (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Communications and Networking (ComNet) has been working with Motorola for over two years to develop a plan for migrating the existing public radio system to a more current, better supported version.
2. The existing system is nine years old. The current version of the radio system has nearly reached the end of its useful life. Motorola no longer provides technical support for the system.
3. Migration to a more recent version is necessary to ensure system reliability and obtain adequate technical support. ComNet began planning for this upgrade in 2000.
4. The acquisition of replacement software is additionally necessary to provide support to all components in the public safety system. Several components will be replaced or upgraded under the proposed agreement.
5. The Proposal received from Motorola is priced in a manner to make it economically beneficial to proceed prior to December 27, 2002. Proceeding prior to December 27, 2002 will allow the City to receive a discount of over $350,000.00.
6. The Council has previously considered upgrading the public radio system. On October 30, 2002, the Council accepted a report from ComNet on the public safety radio system, which recommended the upgrade proceed during FY 2002-03.
7. Funds for this contract are currently available in the Bureau of Communications and Networking’s FY 2002-03 Budget.

NOW, THEREFORE, the Council directs:
a. The Chief Administrative Officer is authorized execute an agreement with Motorola in a form which has been approved by the City Attorney in an amount not to exceed $3.1 million. The Agreement shall contain the essential elements set forth in the form of agreement attached hereto as Exhibit A.

b. The Director of the Bureau of Communications and Networking shall finalize the
terms of the agreement with representatives from Motorola. Prior to the
execution of the agreement, it must be approved as to form by the City
Attorney’s Office.
c. The Mayor and Auditor are authorized to draw and deliver checks when demand is presented and approved by the proper authorities.
Section 2. The Council declares that an emergency exists in order that there be no delay in implementing the public radio system upgrades and taking advantage of the discount; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
