ORDINANCE No. 177113

* Authorize agreement for work on and under property owned by Portland Terminal Railroad Company for the West Side Combined Sewer Overflow Project, Project No. 6680 (Ordinance)

The City of Portland ordains:

Section 1.  The Council finds:

1.  The Bureau of Environmental Services is engaged in a program to control combined sewer overflows (CSO’s) that currently reach the Willamette River.

2.  The Bureau of Environmental Services needs to cross under/over property owned by the Portland Terminal Railroad Company (PTRC) for construction of the Project. This will require a permit from PTRC and the furnishing of flaggers.

3.  The estimated cost for crossing Portland Terminal Railroad company property is $90,000. Funds are available in the Sewer System Operating Fund, FY 2002-03 Budget, Bureau of Environmental Services, Center Code 145 22 110, Project No. 6680, Acct. Code 567000.

NOW, THEREFORE, the Council directs:

a.  The Director of the Bureau of Environmental Services is authorized to execute an agreement, in forms substantially similar to what is attached as Exhibit A with Portland Terminal Railroad Company as finalized and approved as to form by the City Attorney

b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

Section 2.  The Council declares that an emergency exists because a delay in the execution of the agreement might result in delays to the construction of the project. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
