ORDINANCE No. 177092
* Revise requirements regarding appointment and responsibilities of City Engineer (Ordinance; amend Code Sections 3.12.010, 3.12.050, 10.10.030 and 17.4.30)
The City of Portland ordains:
Section 1. The Council finds:
1. City Code currently requires that the City Engineer be the Bureau Manager of the Bureau of Transportation Engineering and Development.
2. City Code also requires that the Bureau of Transportation Engineering and Development be supervised by a Professional Engineer.
3. The responsibilities and duties of the Bureau of Transportation Engineering and Development can be performed by a Director who is not a Professional Engineer.
4. The responsibilities and duties of the City Engineer shall be performed by a Professional Engineer in the Office of Transportation.
NOW, THEREFORE, the Council directs:
a. Title 3, Administration, is amended as follows:
(1) 3.12.010 Organization. (Amended by Ordinance No. 161502, effective December 22, 1988). The Portland Office of Transportation shall be under the direction and control of the Director of Transportation. The Director shall be responsible for the overall coordination and management of the bureaus of the Portland Office of Transportation to assure the goals of the City Council are met and the mission and goals of the Portland Office of Transportation are achieved. This includes responsibility for productivity, responsiveness and effectiveness of the services and programs of the Portland Office of Transportation. The Portland Office of Transportation shall be charged with the responsibility for the finance, operation, maintenance and improvement of the transportation system and shall be made up of the bureaus, under the direction and control of the Director, as set forth in this Chapter. The City Engineer shall be a Bureau Manager an employee within the Portland Office of Transportation. but shall perform the required duties of the position as direct staff support to the Director Responsibilities and authorities of the City Engineer provided in this Code shall be performed by a Professional Engineer.
(2) 3.12.050 Bureau of Transportation Engineering and Development. (Amended by Ordinance No. 173627, effective August 4, 1999.) The Bureau of Transportation Engineering and Development shall be supervised by a Professional Engineer Bureau Manager and shall include such other employees as the Council may provide. This Bureau shall be responsible for the engineering, design and construction of the City’s transportation facilities.
b. Title 10, Erosion and Sediment Control Regulations, is amended as follows:
(1) 10.10.030 Authority.
A. General.
2. For development and construction related activities within the public Right-of-Way, this Title shall be administered and enforced by the director of the Bureau that is performing or contracting for the development or construction, specifically, the City Engineer for the Bureau of Transportation and Development, Director of the Office of Transportation, the Director of the Bureau of Environmental Services, and the Administrator of the Bureau of Waterworks.
The remainder of this section is unchanged.
c. Title 17, Public Improvements, is amended as follows:
(1) 17.04.030 City Engineer. (Amended by Ordinance No. 173295, effective April 28, 1999.) “City Engineer” means the duly appointed City Engineer, or lawfully appointed subordinate of the City Engineer acting under the City Engineer's orders. or designee.
Section 2. The Council declares that an emergency exists because the Office of Transportation must proceed to fill vacancies. Therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
