ORDINANCE No. 177086
* Authorize execution of a License for Fiber Optic Line with Burlington Northern and Santa Fe Railway Company (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City requires access to property owned by Burlington Northern and Santa Fe Railway Company for the purpose of constructing and maintaining a fiber optic crossing for the Integrated Regional Network Enterprise (IRNE) project.
2. Burlington Northern and Santa Fe Railway Company is willing to grant the City such access.
NOW, THEREFORE, the Council directs:
a. The Chief Administrative Officer or his designee, the Director of Communications and Networking, is authorized to execute an agreement substantially in the form attached hereto as Exhibit 1.
b. The Mayor and the Auditor are authorized to draw and deliver a check in the amount of $2,500.00 to Burlington Northern and Santa Fe Railway Company as a one time payment for the required access.
Section 2. The Council declares that an emergency exists in order that there be no delay in executing the License for Fiber Optic Line; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
