* Authorize Wholesale Sewer Service Agreement with the City of Gresham (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The current wholesale sewer service agreement between Portland and Gresham, enacted in 1995, provides for transportation and treatment by Portland of sewage discharged from properties within Gresham. Currently, Portland treats the sewage from approximately 730 equivalent dwelling units (EDUs) within Gresham.
2. Since that 1995 agreement, Portland has provided sewer service to 76.4 EDUs, which, due to topography or other reasons, require sewage transportation and treatment services be provided by Gresham.
3. The new agreement provides authority for Gresham to accept Portland sewage, and sets the terms for payment, including credits on Gresham's quarterly payments to Portland for treatment of Portland sewage. Portland will be required to pay $75,620 in connection charges for these connections to Gresham's sewer system, as well as $46,586.33 in accumulated service charges on Portland connections.
NOW, THEREFORE, the council directs:
a. The Director of the Bureau of Environmental Services is hereby authorized to execute an agreement with Gresham, attached as Exhibit A, for the purpose described in Section 1.
b. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.
Section 2. The Council declares that an emergency exists because both parties desire this new agreement to be in effect for the first quarter billing covering July 1 to September 30 of this year. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
