*Authorize City Engineer to designate and assign City-owned access control strips as public street area. (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  As part of the development process, the City accepts access control strips to be held for future public street area.

 

2.  As the abutting property is subdivided or partitioned, the Council must designate and assign the access control strips, or portions thereof, as public street area.

 

3.  In order to save time and expenses, the City Engineer waits until a number of access control strips need to be designated and assigned before sending an Ordinance to Council.

 

4.  Development plans are delayed until the access control strip is designated as public street area in order to avoid “land locked”, therefore illegal, parcels.

 

5.  In order to expedite and reduce the City’s expense in the designation and assignment process, the City Engineer should be authorized to designate and assign access control strips, or portions thereof, as public street area as the abutting property is subdivided or partitioned, or when no longer needed.

 

NOW, THEREFORE, the Council directs:

 

a.  That the City Engineer is hereby authorized to designate and assign City-owned access control strips, or portions thereof, as public street area as the abutting property is subdivided or partitioned, or when no longer needed.

 

b.  That the Auditor shall forward copies of this Ordinance to the Director of the Office of Transportation and the City Engineer.

 

c.  That the Right-of-Way Acquisition Section, Transportation Engineering and Development shall record in the appropriate public records, documents as necessary to establish the access control strips as public street area.

 

Section 2. The Council declares that an emergency exists because a delay in designating and assigning the control strips or portions thereof might cause confusion in the public records and delay the reduction in expenses; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
