ORDINANCE No. 177068

 

*Amend contract with Western Equipment Distributors, Inc. for turf maintenance equipment (Ordinance: amend Contract No. 28271)

 

The Council Finds:

 

1.  The Bureau of Parks and Recreation has an ongoing need to purchase turf maintenance parts and equipment for the City’s park mowing equipment.

2.  Through Ordinance 165459 (May 13, 1992), and in accordance with ORS 279.015, the City Council exempted this contract from competitive bidding due to increased efficiencies and cost savings through equipment standardization.

3.  A five-year contract was awarded to Pac-West Distributing and was subsequently amended to run through 1999. This contract was assigned to Western Equipment Distributors, Inc. in September of 1999. A second amendment was passed extending the contract through September of 2002.

4.  The Bureau of Parks and Recreation currently has the same standardized equipment with their turf mowers as when contract was originally awarded and requires a continuing source for future purchases.

5.  It is in the best interest of the City of extend this contract through June 30, 2003. This will allow the Bureau of Parks and Recreation and City Purchasing Agents the necessary time to review new product lines of equal value, utility or merit, and make the determination as to if standardization of turf maintenance equipment is still a viable option for securing a new annual contract.

6.  The Purchasing Agent should be authorized to extend this contract for an additional term through June 30, 2003.

 

NOW, THEREFORE, the Council directs:

 

a)  The Purchasing Agent is hereby authorized to execute a contract amendment to extend this agreement through June 30, 2003, the maximum allowable contract term.

 

b)  The Mayor and Auditor are authorized to draw and deliver warrants chargeable to the appropriate budget when demand is presented and approved by the proper authorities.

 

Section 2  The Council declares that an emergency exists because a delay in proceeding with these amendments may result in additional expense and delay, and will unnecessarily deprive the City of the benefits of completion of the contract at an early date. Therefore, this ordinance shall be in force and effect from and after its passage by the Council.
